General Motor's Hummer division has won the first round of the lawsuit againt Jeep regarding the 7-slotted grill design.

Yahoo News! is reporting that General Motors Hummer division has won the first round of the lawsuit against DaimlerChrysler regarding the design of their new Hummer H2. DaimlerChrysler contends that the design of the H2's grill too closely resembles the Jeep's grill design. Here's a snippet:

A federal judge on Thursday denied DaimlerChrysler AG's bid to force General Motors Corp. to make last-minute changes to the Hummer H2 sport utility vehicle, rejecting Chrysler's claim that the H2's grille too closely resembles those on its Jeeps.

Chrysler said it had not decided whether to appeal the ruling, but would continue to pursue its case at a trial scheduled for December.

It had asked for a preliminary injunction saying the H2, scheduled to go on sale in the United States this summer, copies the grille design of its four Jeep models. The Hummer grille features seven vertical slots. Jeep grilles also have seven vertical slots.

The four-wheel-drive H2 is the first new vehicle from Hummer since GM acquired the brand name in 1999. It is part of an ambitious growth plan GM has laid out for high-profit SUVs. Hummer currently builds the H1, a low-volume civilian model of the Humvee military vehicle that captured the public's eye during the Gulf War in 1991.

GM had filed its own lawsuit against Chrysler, charging that the automaker waived any claims it had on the grille by remaining silent in the years since the first Hummer H1 went into production in 1992.

With the H2, expected to be priced at around $50,000, GM brings the Hummer brand closer to Jeep territory. A future H3 is expected to be priced at around $30,000, posing a direct challenge to Jeep.

GM expects eventually to sell 35,000 to 40,000 Hummer H2s a year, compared with Hummer H1 annual sales of around 1,000. GM spokesman Alan Adler said the H2 would hit showrooms as planned.

"We're gratified that the court has not stopped us from using our grille," he said.

Here's DaimlerChrysler's official response:

DaimlerChrysler Corporation is reviewing the court's decision today denying a preliminary injunction to stop General Motors' use of the Hummer H2 grille design, which is similar to the grilles used on Jeep® vehicles.

DaimlerChrysler looks forward to presenting its complete case at the December hearing when a full trial will be held. The company will continue to protect the design of its Jeep grille which has been a famous and unique identifier of the Jeep brand for more than 55 years.

The company has not yet determined whether it is appropriate to file an appeal.

There are a lot of Jeep status wanna be's out there who would love to claim the history and heritage of the Jeep. It doesn't matter one iota how Jeep came out on top in the beginning as far who was the first to market the 4 wheel drive system, the fact that Ford had a contract from Willy's to build the Jeep during War 2 etc. etc. etc. The fact remains that Jeep emerged, and has established the history and heritage.............long before GM knew what an offroad vehicle was. It's the same with all of the Japanese SUV's and 4x4's. Remember Japan was known for crap...hence the phrase "Jap Crap". I believe that Jeep deserves the right to preserve there trademark grill. Ask yourself....if Jeep doesn't set the precedence then why did Hummer try to emulate the grill....."Jeep...there's only one"!

They'd have something worth selling. Live axles are the ticket for offroad play or work. And here they are worrying about a damned grill..

Go Hummer! I hope GM takes it all the way home and shoves it so far up DCX's posterior they'll try to get it out for a couple of years....

Screw DCX...I just made my first $32K purchase outside of my usual Jeep loyalty. That's how the Libby was dealt with in this household.

I belong to an off road club and there are many different types of vehicles that participate in our runs, and I will say that there is only one GM product that is a member. That would be a full size blazer. It goes no where and does nothing. I think the major mod on that thing is a Tow Strap permanemtly attached to the front.

Let's see that Ave go off road. (and your gravel driveway does not count)

Go anywhere, do anything, but only in a Jeep.

Hey Chevy Avalanche, you should check your facts before you talk. The H2 DOES NOT have a solid axle. It is the same IFS/torsion bar set-up on the Chevy Tahoe. The H2 is a sham, because it is basically a Tahoe with the H2 body, and bigger tires. The "look" of a 4x4 has nothing to do with off-road performance. Just because you think the Liberty is "cute", doesn't mean it doesn't work.

I don't claim tobe a lawer so I don't know what the laws are for this but, it looks to me that GM is trying to piggyback on the history and love of the jeep that people have.Maybe love is to strong of a word for some but i love my jeep. I hope the courts see fit to force GM to change the H2 grille design. Just my .02
