The class action suit against DaimlerChrysler for "excessive noise" in 1991-1995 Jeep 4.0L models was dismissed late last week. Here's the scoop from Yahoo news: An Illinois state judge on Wednesday tossed out a class-action lawsuit seeking $500 million in damages from DaimlerChrysler AG's North American unit for noisy Jeep engines, the automaker said.
After nine weeks of trial, Judge Thomas P. Durkin of the Illinois District Court, Chancery Division, in Chicago said the plaintiffs had failed to make their case, which was filed on behalf of about 1.2 million owners of 1991-95 model Jeep Cherokees with 4-liter engines, DaimlerChrysler said.
Plaintiff attorneys could not be reached to comment on Wednesday.
DaimlerChrysler associate general counsel Lewis Goldfarb praised the verdict. ``Common sense prevailed in our legal system today,'' he said in a statement. ``Unfortunately, millions of dollars have been spent proving the obvious: it's OK for engines to make noise.''
He blamed the lawsuit on greed on the part of plaintiffs' attorneys and said there was no defect in the Cherokee sport utility vehicles.
Plaintiffs' attorney had claimed ``excessive noise,'' DaimlerChrysler said.
The case was originally filed in 1994 against the former Chrysler Corp., which merged last year with Germany's Daimler-Benz AG. The case was granted class-action status in 1996 and the case was amended to name DaimlerChrysler Corp., the German-U.S. automaker's North American unit, as defendant.
